As for the trademark, you are a branch off of the Austrian association that holds the trademark, which allows for you to persue avenues against someone who has taken the name wrongfully. you don't necessarly to own the trademark to have an upperhand. Plus trademark infringement suites bring in a lot of money. Its a serious situation and judges don't usually take lightly to it.
Besides the haflinger was bred to be short in WWII for packanimals. there is no need for pack horses anymore(at least majorably). So therefore they want taller horses for the pleasure aspects. Like dressage. I am not saying that a short haflinger is not valuable in its own sense but the US doesn't have any stipulations against them. How many people sell to eurpoeans anyway? How does really impact the majority of the US haflinger owners? I have a short haflinger myself. I love him to death and he's super sweet, but i also have two taller ones and they are just as sweet as my short guy. They are all willing to work, and learn and they love me just as i love them. Just because the other two are a bit taller doesn't make them any less a haflinger.
